In this labour case, the Federal Labour Court decided by recognition judgment. In such a case, the appellate judgments below are to be set aside or amended in accordance with the acknowledgment; costs follow the result of the acknowledgment and are borne by the defendant.

Auf die Revision des Klägers wird das Urteil des Landesarbeitsgerichts München vom 30. März 2010 - 6 Sa 1199/09 - aufgehoben. Auf die Berufung des Klägers wird das Urteil des Arbeitsgerichts Augsburg vom 18. November 2009 - 10 Ca 4151/08 - abgeändert und die Beklagte verurteilt, an den Kläger einen Bruttobetrag iHv. 9.203,00 Euro nebst Zinsen iHv. fünf Prozentpunkten über dem Basiszinssatz seit dem 1. Dezember 2008 zu zahlen.
Die Beklagte trägt die Kosten des Rechtsstreits.
