In a labour dispute on revision, the Federal Labour Court set aside the Cologne Higher Labour Court judgment and rejected the defendant's appeal against the Cologne Labour Court judgment. The defendant had acknowledged the claim, so the court issued an acknowledgment judgment without statement of facts or reasons under § 313b(1) sentence 1 ZPO. Costs of the appeal and revision were imposed on the defendant.

Erklärt der Beklagte den Klageanspruch in der Revisionsinstanz an, kann das Revisionsgericht ein Anerkenntnisurteil erlassen; von der Darstellung des Tatbestands und der Entscheidungsgründe ist abzusehen. In diesem Fall ist das angefochtene Berufungsurteil aufzuheben und die Berufung gegen das erstinstanzliche Urteil zurückzuweisen; die Kosten des Rechtsmittels tragen regelmäßig die unterliegende Partei.

Die Berufung des Beklagten gegen das Urteil des Arbeitsgerichts Köln vom 16. April 2008 - 10 Ca 7399/07 - wird zurückgewiesen.
Der Beklagte hat die Kosten der Berufung und der Revision zu tragen.
