The Federal Labour Court partially set aside the Hessian Labour Court's judgment in a salary dispute against a state employer. It held that the claimant's appeal was inadmissible insofar as it sought a declaration of entitlement to BAT IV b basic salary at the highest age step for the period from 1 August 2008 to 31 December 2009. The court also ordered the claimant to bear the costs of the appeal and revision. The parties had waived a statement of facts and reasons because of a leading parallel case.
§ 72 Abs. 5 ArbGG; § 555 Abs. 1 Satz 1, § 313a Abs. 1 Satz 2 ZPO: Where the parties waive findings of fact and reasons in view of a leading parallel case, the Federal Labour Court may decide by abbreviated judgment. In such a constellation, the dispositive outcome may be limited to partial reversal and dismissal of an appeal as inadmissible; the court need not provide a full factual recitation or substantive reasoning beyond the operative part.

Auf die Revision des beklagten Landes wird das Urteil des Hessischen Landesarbeitsgerichts vom 6. Januar 2010 - 2 Sa 1291/09 - teilweise aufgehoben.
Die Berufung der Klägerin gegen das Urteil des Arbeitsgerichts Gießen vom 16. April 2009 - 1 Ca 63/09 - wird im Umfang der Feststellung, dass das beklagte Land verpflichtet ist, der Klägerin Grundvergütung nach der Vergütungsgruppe IV b der Anlage 1a zum BAT nach der höchsten Lebensaltersstufe dieser Vergütungsgruppe für die Zeit vom 1. August 2008 bis zum 31. Dezember 2009 zu zahlen, als unzulässig verworfen.
Die Klägerin hat die Kosten der Berufung und der Revision zu tragen.
