The Federal Labour Court partly set aside the Hessian Regional Labour Court’s judgment and held that the plaintiff’s appeal was inadmissible to the extent it sought a declaration of entitlement to base salary in pay group V b at the highest age step for 1 May 2008 to 31 December 2009. The court also ordered the plaintiff to pay the costs of the appeal and revision. The parties had waived factual findings and reasons because the case was linked to a parallel leading case.

§ 72 Abs. 5 ArbGG; § 555 Abs. 1 Satz 1, § 313a Abs. 1 Satz 2 ZPO: When the parties waive findings of fact and reasons in a revision proceeding linked to a lead case, the Federal Labour Court may dispose of the matter without a full factual statement. If the appeal is directed only against a specific declaratory part of the first-instance judgment, the admissibility of the appeal must be assessed precisely by reference to that object; an appeal attacking an object outside the permissible scope is to be rejected as inadmissible. The cost consequence follows the unsuccessful party in the revision and appeal stages.
