In this employment dispute, the Federal Labour Court dealt with the defendant state's revision against a judgment of the Hessisches Landesarbeitsgericht. Die Kosten des erfolglosen Rechtsmittels folgen der Unterliegensfolge.

Auf die Revision des beklagten Landes wird das Urteil des Hessischen Landesarbeitsgerichts vom 6. Januar 2010 - 2 Sa 1123/09 - teilweise aufgehoben.
Die Berufung der Klägerin gegen das Urteil des Arbeitsgerichts Marburg vom 17. April 2009 - 2 Ca 98/09 - wird im Umfang der Feststellung, dass das beklagte Land verpflichtet ist, der Klägerin Grundvergütung nach der Vergütungsgruppe IV b der Anlage 1a zum BAT nach der höchsten Lebensaltersstufe dieser Vergütungsgruppe für die Zeit vom 1. Juni 2008 bis zum 31. August 2008 zu zahlen, als unzulässig verworfen.
Die Klägerin hat die Kosten der Berufung und der Revision zu tragen.
