  1. Auf die Revision des Klägers wird das Urteil des Landesarbeitsgerichts Sachsen-Anhalt vom 17. April 2009 - 9 Sa 403/08 - aufgehoben.

  2. Die Berufung der Beklagten gegen das Urteil des Arbeitsgerichts Stendal vom 6. August 2008 - 4 Ca 71/08 - wird zurückgewiesen.

  3. Die Beklagte hat auch die Kosten der Berufung und der Revision zu tragen.
