The Federal Labour Court dismissed the employee's revision against the Hessian Regional Labour Court in a dispute concerning an employer loan and a contractual limitation period. The parties had waived a statement of facts and reasons because of a parallel lead case. The court therefore issued only the operative part: the revision was rejected and the employee had to bear the costs of the revision.
§ 72 Abs. 5 ArbGG; § 555 Abs. 1 Satz 1, § 313a Abs. 1 Satz 2 ZPO; where the parties, in view of a leading parallel case, waive statement of facts and reasons, the Federal Labour Court may decide by judgment without such sections. The procedural economy of a shortened judgment form does not affect the dispositive review of the revision; if the revision is unfounded, it is to be dismissed and the unsuccessful appellant bears the revision costs.
