Tenor

  1. Das Verfahren wird in den Fällen 7, 9, 33 und 35 der Anklageschrift auf den Vorwurf der gewerbsmäßigen Hehlerei beschränkt; die in diesen Fällen jeweils auf den Vorwurf der Anstiftung zum Diebstahl entfallenden Kosten des Verfahrens und die dem Angeklagten insoweit entstandenen notwendigen Auslagen trägt die Staatskasse.

  2. Die Revision des Angeklagten gegen das Urteil des Landgerichts Düsseldorf vom 31. August 2015 wird als unbegründet verworfen, da die Nachprüfung des Urteils aufgrund der Revisionsrechtfertigung keinen Rechtsfehler zum Nachteil des Angeklagten ergeben hat.

  3. Der Beschwerdeführer hat die verbleibenden Kosten seines Rechtsmittels zu tragen.

Gründe

1 Das Landgericht hat den Angeklagten wegen gewerbsmäßiger Hehlerei in sechs Fällen, Anstiftung zum Diebstahl in zwei Fällen sowie Anstiftung zum versuchten Diebstahl zu einer Gesamtfreiheitsstrafe von zwei Jahren und sechs Monaten verurteilt. Dagegen wendet sich der Beschwerdeführer mit seiner auf die Rüge der Verletzung formellen und materiellen Rechts gestützten Revision. Das Rechtsmittel führt in dem aus der Entscheidungsformel ersichtlichen Umfang zur Beschränkung des Verfahrens; im Übrigen ist es unbegründet im Sinne von § 349 Abs. 2 StPO.

2 Die auf die Sachrüge veranlasste umfassende materiellrechtliche Überprüfung des Urteils hat zum Schuld- und Strafausspruch keinen Rechtsfehler zum Nachteil des Angeklagten ergeben. Indes hat das Landgericht in den Fällen 7, 9, 33 und 35 der Anklageschrift versäumt, sich mit den als tatmehrheitlich zu den Delikten der gewerbsmäßigen Hehlerei angeklagten und mit diesen eine prozessuale Tat bildenden Vorwürfen der Anstiftung zum Diebstahl auseinanderzusetzen. Ist ein Nachweis nicht wegen aller Delikte möglich, die nach der Anklage in Tatmehrheit (§ 53 StGB) begangen sein sollen, muss grundsätzlich freigesprochen werden (vgl. BGH, Beschluss vom 13. Januar 2016 - 5 StR 485/15, juris Rn. 4; Meyer-Goßner/Schmitt, StPO, 59. Aufl., § 260 Rn. 13 mwN auch zu den Ausnahmen). Mit Zustimmung des Generalbundesanwalts beschränkt der Senat daher das Verfahren in diesen Fällen gemäß § 154a Abs. 1 Satz 1 Nr. 2, Abs. 2 StPO jeweils auf den Vorwurf der gewerbsmäßigen Hehlerei.

3 Auf die "Rüge nach § 349 Abs. 2, 338 Ziff. 7/8; 203; 260 Abs. 1, 4 StPO" kommt es damit nicht mehr an. Die Rüge der Verletzung von § 257c Abs. 4 und 5, § 273 Abs. 1a StPO ist aus den in der Antragsschrift des Generalbundesanwalts dargelegten Gründen unzulässig.

4 Die auf die Vorwürfe der Anstiftung zum Diebstahl in den Fällen 7, 9, 33 und 35 entfallenden Kosten des Verfahrens und die dem Angeklagten insoweit entstandenen notwendigen Auslagen waren der Staatskasse aufzuerlegen. Zwar ist bei einer Beschränkung der Strafverfolgung gemäß § 154a StPO wegen des vorläufigen Charakters dieser Entscheidung eine Kostenentscheidung grundsätzlich ausgeschlossen. Dies gilt aber nicht, wenn - wie hier - gleichzeitig mit der Beschränkung der Strafverfolgung auf einzelne Teile der Tat das Urteil durch Verwerfung der Revision über die von der Beschränkung nicht betroffenen Teile rechtskräftig wird (BGH, Beschluss vom 15. Juni 1993 - 4 StR 287/93, BGHR StPO § 154a Kostenentscheidung 1).
