Die Beschwerde des Klägers gegen die Nichtzulassung der Revision in dem Beschluss des Oberlandesgerichts Bamberg - 1. Zivilsenat - vom 16. September 2015 - 1 U 143/14 - wird zurückgewiesen, weil weder die Rechtssache grundsätzliche Bedeutung hat noch die Fortbildung des Rechts oder die Sicherung einer einheitlichen Rechtsprechung eine Entscheidung des Revisionsgerichts erfordert (§ 543 Abs. 2 Satz 1 ZPO).

Das Berufungsgericht hat in seinem Hinweisbeschluss vom 17. August 2015 zwar verkannt, dass die Senatsentscheidung vom 12. Februar 2004 (III ZR 359/02, BGHZ 158, 110, 116 ff) zur Aufklärungspflicht über Innenprovisionen nicht bankengebundene Vermittler, sondern freie Anlagevermittler betrifft. Es hat jedoch im Anschluss die Ausführungen des Landgerichts zitiert, in denen die Senatsrechtsprechung zur Aufklärungspflicht des freien, nicht bankmäßig gebundenen Anlageberaters über Vertriebsprovisionen (Senatsurteil vom 3. März 2011 - III ZR 170/10, WM 2011, 640 Rn. 11) zutreffend wiedergegeben wird. Zudem ist ein etwaiges Missverständnis der Senatsrechtsprechung durch das Berufungsgericht vorliegend nicht entscheidungserheblich. Denn die maßgeblichen Emissionsprospekte enthalten entgegen der Ansicht der Beschwerde alle erforderlichen Informationen zu den von ihr angeführten Vertriebs- und Fondsnebenkosten. Aufgrund der zulassungsrechtlich unbedenklichen Beweiswürdigung des Berufungsgerichts ist davon auszugehen, dass sie dem Kläger auch rechtzeitig übergeben wurden. Eine weitergehende Aufklärungspflicht der Beklagten bestand daher nicht (vgl. Senatsurteil vom 12. Dezember 2013 - III ZR 404/12, WM 2014, 118 Rn. 12 ff).

Von einer weiteren Begründung wird gemäß § 544 Abs. 4 Satz 2 Halbsatz 2 ZPO abgesehen.

Der Kläger trägt die Kosten des Beschwerdeverfahrens (§ 97 Abs. 1 ZPO).
