Die Beschwerde gegen die Nichtzulassung der Revision in dem Urteil des 9. Zivilsenats des Oberlandesgerichts Naumburg vom 27. Februar 2014 wird auf Kosten der Klägerin verworfen.

Gründe

1 Die Nichtzulassungsbeschwerde der Klägerin ist unzulässig, da die mit der Revision geltend zu machende Beschwer den nach § 26 Nr. 8 Satz 1 EGZPO erforderlichen Wert von mehr als 20.000 € nicht erreicht.

2 Das Berufungsgericht hat den mit Schriftsatz der Klägerin vom 26. November 2012 modifizierten Klageantrag als eine Beschränkung ihres Feststellungsbegehrens auf den Monat August 2012 gewertet. Das ist nicht zu beanstanden. Die Klägerin hat ihren Antrag ausdrücklich unter Hinweis auf die "sich seit Klageerhebung ergebenden weiteren Entwicklungen im Sachverhalt" angekündigt. Die Parteien sind sich wenn auch aus unterschiedlichen Gründen über die Beendigung des Mietverhältnisses mit dem 31. August 2012 einig gewesen. Zumal das Objekt an diesem Tag auch unstreitig geräumt und herausgegeben worden ist, hat das Berufungsgericht den geänderten Antrag der Klägerin in zulässiger Weise dahin ausgelegt, dass die Feststellung des Nichtbestehens eines nach Auffassung beider Parteien ab 1. September 2012 nicht mehr bestehenden Anspruchs auf Nutzungsentgelt nicht begehrt werde. Auf den mit der Widerklage geltend gemachten Schadensersatzanspruch bezieht sich der (negative) Feststellungsantrag nicht mehr.

3 Es kann dahingestellt bleiben, ob die Klägerin ihre Klage teilweise zurückgenommen oder den Rechtsstreit insoweit für erledigt erklärt hat und ob der Beklagte sich einer teilweisen Erledigungserklärung angeschlossen hat. Denn in keinem Fall übersteigt die Beschwer 20.000 €.
