Revision im Strafverfahren: Wiederherstellung der Öffentlichkeit und Beweiskraft des Protokolls

Tenor

Auf die Revision des Angeklagten wird das Urteil des Landgerichts Bielefeld vom 17. Juni 2015 mit den Feststellungen aufgehoben.

Die Sache wird zu neuer Verhandlung und Entscheidung, auch über die Kosten des Rechtsmittels, an eine andere Strafkammer des Landgerichts zurückverwiesen.

Gründe

1 Das Landgericht hat den Angeklagten wegen Vergewaltigung in Tateinheit mit Amtsanmaßung, wegen Betruges in zwei Fällen und wegen Diebstahls zu einer Gesamtfreiheitsstrafe von drei Jahren und neun Monaten verurteilt. Hiergegen richtet sich seine auf die Verletzung formellen und materiellen Rechts gestützte Revision.

2 Das Rechtsmittel hat mit der auf den absoluten Revisionsgrund des § 338 Nr. 6 StPO gestützten Verfahrensrüge Erfolg.

3 Das Landgericht hat während des Hauptverhandlungstermins vom 27. Mai 2015 für die Dauer der Vernehmung der Zeugin M. gemäß § 171b Abs. 1 Satz 1 GVG die Öffentlichkeit ausgeschlossen. Das Protokoll vermerkt nicht, dass nach der Entlassung der Zeugin die Öffentlichkeit wiederhergestellt worden wäre. Die Wiederherstellung der Öffentlichkeit gehört jedoch zu den wesentlichen Förmlichkeiten, für die die besondere Beweiskraft des Protokolls nach § 274 StGB gilt (vgl. BGH, Beschluss vom 31. März 1994 – 1 StR 47/94, BGHR StPO § 274 Beweiskraft 15; BGH, Beschluss vom 21. Juli 2000– 3 StR 228/00, bei Becker NStZ-RR 2001, 264 Nr. 26 jew. mwN). Das – weder lückenhafte noch widersprüchliche – Protokoll beweist daher, dass die sich anschließende weitere Hauptverhandlung – wie von der Revision geltend gemacht – in unzulässiger Abwesenheit der Öffentlichkeit stattgefunden hat. Damit ist der absolute Revisionsgrund des § 338 Nr. 6 StPO erfüllt, so dass das angefochtene Urteil aufgehoben werden muss (vgl. zum Ganzen auch BGH, Beschluss vom 14. Mai 2002 – 3 StR 95/02).
