Tenor

  1. Auf die Revision des Angeklagten gegen das Urteil des Landgerichts Dortmund vom 15. Januar 2013 wird

a) das Verfahren eingestellt, soweit der Angeklagte in den Fällen II. 2 und 3 der Urteilsgründe verurteilt worden ist; insoweit trägt die Staatskasse die Kosten des Verfahrens und die notwendigen Auslagen des Angeklagten;

b) das vorgenannte Urteil dahin geändert, dass der Angeklagte wegen unerlaubter Einfuhr von Betäubungsmitteln in nicht geringer Menge in Tateinheit mit unerlaubtem Handeltreiben mit Betäubungsmitteln in nicht geringer Menge zu der Freiheitsstrafe von drei Jahren und sechs Monaten verurteilt wird.

  1. Die weiter gehende Revision wird verworfen.

  2. Der Angeklagte trägt die verbleibenden Kosten des Rechtsmittels.

Gründe

1 Das Landgericht hat den Angeklagten wegen unerlaubter Einfuhr von Betäubungsmitteln in nicht geringer Menge in Tateinheit mit unerlaubtem Handeltreiben mit Betäubungsmitteln in nicht geringer Menge in drei Fällen zu der Gesamtfreiheitsstrafe von vier Jahren und neun Monaten verurteilt. Hiergegen richtet sich die Revision des Angeklagten mit der nicht näher ausgeführten Sachrüge. Der Senat hat nach Durchführung des Anfrageverfahrens mit Beschluss vom 22. Mai 2014 dem Großen Senat für Strafsachen die in der Rechtsprechung des Bundesgerichtshofs unterschiedlich beantwortete Rechtsfrage zur Entscheidung vorgelegt, ob eine einheitliche Tat des unerlaubten Handeltreibens mit Betäubungsmitteln in nicht geringer Menge mehrere zu deren Verwirklichung vorgenommene Einfuhren von Betäubungsmitteln in nicht geringer Menge zu einer Tat der unerlaubten Einfuhr von Betäubungsmitteln in nicht geringer Menge verbindet. Nach der ohne Entscheidung der Vorlegungsfrage erfolgten Rückgabe der Vorlage durch den Großen Senat für Strafsachen (Beschluss vom 17. März 2015 – GSSt 1/14, NJW 2015, 3800) ist der Senat seit dem 4. November 2015 erneut mit der Sache befasst.

2 Mit Blick auf die Entscheidung des Großen Senats für Strafsachen stellt der Senat das Verfahren auf Antrag des Generalbundesanwalts aus prozessökonomischen Gründen gemäß § 154 Abs. 2 StPO ein, soweit der Angeklagte in den Fällen II. 2 und 3 der Urteilsgründe jeweils wegen unerlaubter Einfuhr von Betäubungsmitteln in nicht geringer Menge in Tateinheit mit unerlaubtem Handeltreiben mit Betäubungsmitteln in nicht geringer Menge verurteilt worden ist.

3 In dem nach der Teileinstellung des Verfahrens verbleibenden Umfang ist die Revision des Angeklagten unbegründet, da die Nachprüfung des Urteils aufgrund der Revisionsrechtfertigung keinen Rechtsfehler zum Nachteil des Angeklagten ergeben hat (§ 349 Abs. 2 StPO).

4 Die Teileinstellung des Verfahrens hat die Änderung des Schuldspruchs sowie den Wegfall der für die Taten II. 2 und 3 der Urteilsgründe verhängten Einzelstrafen und der Gesamtstrafe zur Folge. Die Einzelstrafe für die Tat II. 1 der Urteilsgründe von drei Jahren und sechs Monaten bleibt als alleinige Freiheitsstrafe bestehen.
