Tenor

  1. Das Verfahren wird eingestellt.

  2. Der Beschluss des Senats vom 18. August 2015 ist gegenstandslos, soweit er den Angeklagten betrifft.

  3. Die Staatskasse trägt die Kosten des Verfahrens; jedoch wird davon abgesehen, die notwendigen Auslagen des Angeklagten der Staatskasse aufzuerlegen. Sie ist auch nicht verpflichtet, für erlittene Strafverfolgungsmaßnahmen zu entschädigen.

Gründe

1 Das Verfahren ist gemäß § 206a StPO wegen eines Verfahrenshindernisses einzustellen, weil der Angeklagte bereits am 7. April 2015 und damit noch vor der Beschlussfassung über seine Revision verstorben ist (vgl. BGH, Beschluss vom 8. Juni 1999 - 4 StR 595/97, BGHSt 45, 108). Das angefochtene Urteil ist damit - soweit es den Angeklagten betrifft - gegenstandslos, ohne dass es einer Aufhebung bedarf (vgl. BGH, Beschluss vom 13. Juni 2013 - 1 StR 207/13; BGH, Beschluss vom 5. August 1999 - 4 StR 640/98, BGHR StPO § 467 Abs. 3 Verfahrenshindernis 2).

2 Der Umstand, dass der Senat die Revision des Angeklagten in Unkenntnis seines Todes am 18. August 2015 gemäß § 349 Abs. 2 StPO verworfen hat, macht eine förmliche Verfahrenseinstellung nicht entbehrlich. Vielmehr ist zudem aus Gründen der Rechtssicherheit klarzustellen, dass der Verwerfungsbeschluss gegenstandslos ist, soweit er den Angeklagten betrifft (vgl. BGH, Beschluss vom 18. April 2000 - 5 StR 659/99).

3 Die Kosten des Verfahrens fallen gemäß § 467 Abs. 1 StPO der Staatskasse zur Last. Da die Revision des Angeklagten keine Aussicht auf Erfolg hatte, sind nach § 467 Abs. 3 Satz 2 Nr. 2 StPO seine notwendigen Auslagen nicht der Staatskasse aufzuerlegen (vgl. BGH, Beschluss vom 8. Juni 1999 - 4 StR 595/97, BGHSt 45, 108, 116). Auch eine Entschädigung für erlittene Strafverfolgungsmaßnahmen kommt nicht in Betracht (vgl. BGH, Beschluss vom 13. Juni 2013 - 1 StR 207/13).
