Tenor

Die Revision des Angeklagten gegen das Urteil des Landgerichts Stade vom 7. Februar 2014 wird verworfen.

Der Beschwerdeführer hat die Kosten des Rechtsmittels und die den Nebenklägern im Revisionsverfahren entstandenen notwendigen Auslagen zu tragen.

Gründe

1 Die Nachprüfung des Urteils hat keinen Rechtsfehler zum Nachteil des Angeklagten ergeben (§ 349 Abs. 2 StPO).

2 Auch die Adhäsionsentscheidung hat entgegen der Auffassung des Generalbundesanwalts Bestand. Angesichts der mit Blick auf die Taten und ihre erheblichen Folgen für die Nebenkläger sehr niedrig festgesetzten Schmerzensgeldbeträge kann der Senat ausschließen, dass eine weitere Erörterung der wirtschaftlichen Verhältnisse des Angeklagten - in den Feststellungen zu seiner Person ist sein letztes Nettogehalt, das er aus seiner langjährigen Anstellung als Drucker bezog, angegeben und ausgeführt, dass er seine Arbeitsstelle infolge seiner Inhaftierung verlor - und der Nebenkläger - die Nebenklägerin musste bedingt durch die Tat ihre Ganztagsstelle aufgeben - zu einer für den Angeklagten günstigeren Entscheidung geführt hätte.

3 Der Senat kann ungeachtet des Antrags des Generalbundesanwalts nach § 349 Abs. 2 StPO verfahren: Ist nur über die Zubilligung einer Entschädigung zu befinden, kann das Rechtsmittelgericht dies nach § 406a Abs. 2 Satz 2 StPO ohne Hauptverhandlung tun. Dies erfordert, auch dann eine Entscheidung im Beschlusswege zuzulassen, wenn im Übrigen - wie hier - wegen der Schuld- und Straffrage die Voraussetzungen des § 349 Abs. 2 StPO vorliegen, da der Gesetzgeber vermeiden wollte, dass allein wegen der Adhäsionsentscheidung eine Hauptverhandlung stattfindet (BGH, Beschlüsse vom 5. Januar 1999 - 3 StR 602/98, NJW 1999, 1123, 1124 und vom 3. April 2007 - 3 StR 92/07, juris Rn. 5).
