Tenor

Die Revision der Angeklagten gegen das Urteil des Landgerichts Regensburg vom 19. November 2012 wird als unbegründet verworfen, da die Nachprüfung des Urteils auf Grund der Revisionsrechtfertigung keinen Rechtsfehler zum Nachteil der Angeklagten ergeben hat (§ 349 Abs. 2 StPO).

Die Beschwerdeführerin hat die Kosten des Rechtsmittels zu tragen.

Ergänzend bemerkt der Senat:

Die Beschwerdeführerin rügt als Verletzung von § 261 StPO, dass das Urteil nach der Urteilsurkunde auf einer Verständigung nach § 257c StPO beruhe, obwohl eine solche tatsächlich nicht stattgefunden habe, wie sich auch aus dem Protokoll ergebe. Ein revisibler Rechtsfehler ist damit nicht dargelegt. Zwar korrespondiert der Hinweis im Urteil auf eine Verständigung (vgl. § 267 Abs. 3 Satz 5 StPO) nicht mit dem Inhalt des Protokolls und den Angaben der Beschwerdeführerin, dass keine Verständigung stattgefunden hat. Der Senat schließt aber aus, dass sich dieser Fehler auf das Verfahren oder das Urteil zum Nachteil der Angeklagten ausgewirkt hat. Die Überprüfung eines verständigungsbasierten Geständnisses unterliegt grundsätzlich nicht strengeren Anforderungen, als sie an eine Beweisaufnahme in der nach herkömmlicher Verfahrensweise geführten Hauptverhandlung nach Abgabe eines Geständnisses zu stellen wären (BVerfG, Urteil vom 19. März 2013 - 2 BvR 2628/10 u.a., NJW 2013, 1058, 1063 Rn. 71). Vorliegend hat das Landgericht bei seiner Beweiswürdigung das vollumfängliche Geständnis der Angeklagten durch zahlreiche sachliche und persönliche Beweismittel überprüft und bestätigt gefunden.

Es kann daher dahinstehen, ob dem "Berichtigungsbeschluss" des Landgerichts vom 22. April 2013 (Bl. 235 d.A.) Rechtswirkung zukommt, wonach der vor den eigentlichen Urteilsgründen angebrachte und in Klammern gesetzte Hinweis auf eine Verständigung, der vom weiteren Schriftbild der Urteilsgründe deutlich abweicht, wegen eines Schreibversehens entfällt (vgl. demgegenüber Meyer-Goßner, StPO, 55. Aufl., § 267 Rn. 39 mwN).
