Tenor

Die Revision der Angeklagten gegen das Urteil des Landgerichts Zweibrücken vom 10. Februar 2012 wird als unbegründet verworfen, da die Nachprüfung des Urteils auf Grund der Revisionsrechtfertigung keinen Rechtsfehler zum Nachteil der Angeklagten ergeben hat (§ 349 Abs. 2 StPO).

Die Beschwerdeführerin hat die Kosten des Rechtsmittels zu tragen.

Ergänzend bemerkt der Senat:

Die Rüge der Verletzung des § 261 StPO (Revisionsrechtfertigung des Rechtsanwalts L. vom 4. Mai 2012) ist zulässig erhoben, aber unbegründet. Das Gericht hat zu der Frage, welche Angaben der Zeuge S. im Ermittlungsverfahren gemacht hat, die jeweiligen Vernehmungspersonen angehört. Allein die von diesen Zeugen gemachten Angaben gehören zum Inbegriff der Hauptverhandlung gemäß § 261 StPO. Soweit die Revision eine Erörterung von Widersprüchen in den Angaben des Zeugen S. im Ermittlungsverfahren vermisst und sich dazu auf die bei den Akten befindlichen Vernehmungsprotokolle beruft, handelt es sich um urteilsfremdes Vorbringen, dessen Beachtung das Rekonstruktionsverbot entgegensteht (vgl. Meyer-Goßner, StPO, 55. Aufl., § 261 Rn. 38a, § 337 Rn. 14). Gleiches gilt für die Angaben des Zeugen R. K. im Ermittlungsverfahren, zu denen sich das Urteil des Landgerichts nicht verhält.
