Tenor

Die Beschwerde gegen die Nichtzulassung der Revision in dem Urteil des 5. Zivilsenats des Oberlandesgerichts Naumburg vom 2. Februar 2011 wird auf Kosten des Klägers zurückgewiesen.

Der Gegenstandswert des Beschwerdeverfahrens wird auf 59.000 € festgesetzt.

Gründe

1 Die Beschwerde deckt keinen Zulassungsgrund auf.

Die Frage, ob es für das Vorliegen einer Gläubigerbenachteiligung im Sinne des § 129 Abs. 1 InsO bei Übertragung einer Immobilie auf den Verkehrswert oder auf den Wert ankommt, der im Falle der Zwangsversteigerung für den übertragenen Gegenstand hätte erzielt werden könnten, hat keine Grundsatzbedeutung, weil der Senat diese Frage bereits im Sinne des Berufungsurteils geklärt hat (vgl. BGH, Urteil vom 18. Dezember 2008 - IX ZR 79/07, WM 2009, 615 Rn. 11).

3 2. Die Rechtsprechung des Senats zu den Voraussetzungen der Anfechtung einer gemischten Schenkung hat das Berufungsgericht nicht verkannt. Die entsprechende Rüge ist wegen Fehlens des erforderlichen Obersatzvergleiches (vgl. BGH, Beschluss vom 23. März 2011 - IX ZR 212/08, WM 2011, 1196 Rn. 3) im Übrigen schon nicht ausreichend ausgeführt.

4 3. Die Annahme des Berufungsgerichts, der Kläger habe nicht in Abrede genommen, dass der Kaufpreis nicht dem Verkehrswert entsprach, beruht nicht auf Willkür, sondern auf einer nachvollziehbaren Wertung des klägerischen Vortrags.

Die von der Beschwerde aufgeworfene Grundsatzfrage, ob ein Notverkauf der Schenkungsanfechtung nach § 134 InsO unterliegt, ist nicht entscheidungserheblich, weil das Berufungsgericht festgestellt hat, dass ein Notverkauf nicht vorlag und von den Beteiligten auch nicht angenommen werden konnte. Dies wird nicht in zulassungsrelevanter Weise angegriffen.

6 5. Eine Verletzung des rechtlichen Gehörs bezüglich der vom Beklagten Zug um Zug zu erbringenden Gegenleistung liegt nicht vor. Aus Art. 103 Abs. 1 GG folgt keine Pflicht des Gerichts, der von einer Partei vorgetragenen Rechtsansicht zu folgen.

7 6. Von einer weiteren Begründung wird gemäß § 544 Abs. 4 Satz 2 Halbs. 2 ZPO abgesehen.
