Tenor

Die Beschwerde der Beklagten gegen die Nichtzulassung der Revision in dem Urteil des 9. Zivilsenats des Oberlandesgerichts München vom 12. April 2011 wird zurückgewiesen.

Die Beklagte trägt die Kosten des Beschwerdeverfahrens (§ 97 Abs. 1 ZPO).

Gründe

1 Der Senat hat allerdings Bedenken gegen die Auffassung des Berufungsgerichts, ein hinreichend bestimmter Leistungsinhalt sei nicht festzustellen. Aus den Unterlagen dürfte sich ergeben, dass die Parteien als Baureinigung im Sinne der Position 1 des Auftrags eine Vorabreinigung und eine Endreinigung inklusive Glasreinigung zum Pauschalpreis von 38.500 € vereinbart haben. In der Anlage K 3 werden zunächst nachvollziehbar die Preise aus der Absummierung für Vorabreinigung und Endreinigung sowie jeweiliger Glasreinigung zusammengefasst und zudem Preise für optionale Bauleistungen gebildet. In der Anlage K 2 findet sich dann lediglich für die im Verhandlungsprotokoll als Baugrob- und Bauendreinigung beschriebene Leistung der Pauschalpreis von 38.500 €, der naheliegender Weise durch Reduzierung der in der Anlage K 3 genannten Pauschalpreise von 24.610 € und 17.422 € zustande gekommen sein dürfte. Dafür, dass mehrere Baureinigungen in diesem Sinne vereinbart worden sind, ergeben die Kalkulationsunterlagen keinerlei Anhaltspunkte. Soweit der Auftrag unter Position 2 die Baureinigung gemäß Anlage 3 zu einem Stundenlohn von 15,40 € optional erfasst, dürften nach den vorgelegten Unterlagen diejenigen Leistungen gemeint sein, die in der Anlage 3 als optionale Leistungen bezeichnet worden sind.

2 Die dargestellten Bedenken, die sich allerdings nicht aus dem Vorbringen der Beschwerdeführerin ergeben, rechtfertigen eine Zulassung der Revision nicht, weil von dieser ein Zulassungsgrund nicht dargetan ist.

3 Von einer weiteren Begründung wird abgesehen, weil sie nicht geeignet wäre, zur Klärung der Voraussetzungen beizutragen, unter denen eine Revision zuzulassen ist (§ 544 Abs. 4 Satz 2, 2. Halbsatz ZPO).
