Tenor

  1. Auf die Revision des Angeklagten wird das Urteil des Landgerichts Wiesbaden vom 12. August 2011 im Strafausspruch aufgehoben.

  2. Die Sache wird im Umfang der Aufhebung zu neuer Verhandlung und Entscheidung, auch über die Kosten des Rechtsmittels, an eine andere Strafkammer des Landgerichts zurückverwiesen.

  3. Die weitergehende Revision des Angeklagten wird verworfen.

Gründe

1 Das Landgericht hat den Angeklagten wegen bewaffneten unerlaubten Handeltreibens mit Betäubungsmitteln in nicht geringer Menge zu einer Freiheitsstrafe von fünf Jahren verurteilt. Die auf die Sachrüge gestützte Revision des Angeklagten hat im Strafausspruch Erfolg. Im Übrigen ist sie offensichtlich unbegründet (§ 349 Abs. 2 StPO).

2 Die Strafkammer hat in ihrer Gesamtabwägung zur Ablehnung eines minder schweren Falles Umstände angeführt, an deren Berücksichtigung sie von Rechts wegen gehindert war.

3 Das Landgericht durfte zu Lasten des Angeklagten weder in Rechnung stellen, dass "keine spontane Tat ohne Anlass" vorliege, noch anführen, dass der Angeklagte "ohne Druck oder Beeinflussung Dritter" und auch nicht "aus einer Notsituation heraus" gehandelt habe. Nachvollziehbare, verständliche Motive für eine Tatbegehung wie ungünstige wirtschaftliche Verhältnisse oder auch eine Suchterkrankung können ebenso wie die Tatverstrickung durch Dritte strafmildernd zu Buche schlagen; ihr Fehlen berechtigt allerdings nicht, dies zu Lasten des Angeklagten zu berücksichtigen (BGH, Beschluss vom 23. März 2011 - 2 StR 35/11). Soweit die Kammer darüber hinaus in ihren Erwägungen darauf abgestellt hat, es seien "primär finanzielle Erwägungen, die Aussicht auf eine lukrative Einnahmequelle" Anlass für die Tatbegehung gewesen, verstößt sie damit gegen das Verbot der Doppelverwertung von Strafzumessungserwägungen (§ 46 Abs. 3 StGB), da Gewinnstreben zum Tatbestand des Handeltreibens mit Betäubungsmitteln gehört und von einem besonders verwerflichen, den Rahmen des Tatbestandsmäßigen erheblich übersteigenden Gewinnstreben nach den Feststellungen nicht gesprochen werden kann.

4 Der Senat kann - trotz weiterer zu Lasten des Angeklagten aufgeführter Umstände - letztlich nicht ausschließen, dass die Strafkammer ohne die Berücksichtigung der aufgeführten Umstände bei der Prüfung des minderschweren Falles zu einem anderen Ergebnis gekommen wäre. Aus diesem Grund unterliegt der Strafausspruch der Aufhebung.
