Hearing complaint against dismissal of revision rejected

BGH 1 StR 399/11Bgh / I camera penale31 ott 2011Dismissed

Sintesi

The convicted person challenged the BGH’s prior order dismissing his revision and argued that the Senate had failed to address his detailed submissions on both conviction and sentence. The BGH held that a § 349(2) StPO order does not require discussion of every individual argument and that § 356a StPO is limited to remedying actual violations of the right to be heard, not to reopening the merits. As no hearing violation was shown, the complaint was rejected at the applicant’s cost.

Regest

§ 356a StPO; hearing complaint only remedies violations of the right to be heard and cannot serve as a substitute for a renewed merits review; an order under § 349(2) StPO need not engage with each individual argument of the revision in detail. A merely asserted dissatisfaction with the assessment of conviction or sentence does not establish a hearing violation; the complaint is inadmissible or unfounded if it seeks only reconsideration of the substantive outcome.

Strafverfahren: Anhörungsrüge gegen die Verwerfung der Revision

Tenor
