Art. 103(1) GG, § 321a ZPO; a hearing complaint is unfounded where the court has taken account of a party's factual and legal submission but does not adopt the party's legal assessment. A violation of the right to be heard presupposes that relevant submissions were not considered, not merely that they were rejected on the merits. In cases of an unclear place of loss, the court may rely on a secondary burden of presentation of the opposing party; compliance with that burden is a question of substantive assessment, not of constitutional hearing protection.

Anhörungsrüge: Berücksichtigung der gegenteilige Rechtsauffassung

Tenor

Die Anhörungsrüge gegen das Senatsurteil vom 24. Februar 2011 wird auf Kosten der Klägerin zurückgewiesen.

Gründe

1 Die gemäß § 321a ZPO statthafte und auch im Übrigen zulässige Anhörungsrüge ist nicht begründet.

2 Die Klägerin macht ohne Erfolg geltend, der Senat habe unter Verletzung des Art. 103 Abs. 1 GG nicht berücksichtigt, dass sie in ihrer Revisionsbegründung gerügt habe, aufgrund des Unterlassens von Schnittstellenkontrollen seitens der Beklagten müsse eine Beweislastumkehr zu deren Lasten eingreifen; denn nur wegen der fehlenden Schnittstellenkontrollen am Lagerausgang sei nicht sicher feststellbar, ob die Sendung im Center Miami oder auf dem Anschlusstransport zur Empfängerin in Verlust geraten sei.

3 Diesen Vortrag der Klägerin hat der Senat bei seiner Entscheidung berücksichtigt. Er ist nur nicht der von der Klägerin geäußerten Rechtsauffassung beigetreten, sondern hat angenommen, dass die Beklagte im Hinblick darauf, dass der Ort des Verlustes nicht feststeht, eine sekundäre Darlegungslast trifft, der die Beklagte - entgegen der Ansicht der Revision - aber in ausreichendem Maße nachgekommen ist (Rn. 34).
