The Federal Court dismissed the defendant’s revision against the Lübeck Regional Court judgment as unfounded. It held that, in the staged robbery involving a cash transport driver who was informed of the plan, the participants had at least broken the co-possession of DB AG when they took secured cash boxes from the transport vehicle. The driver’s involvement did not prevent a theft under § 242 Abs. 1 StGB. The appellant was ordered to bear the costs of the revision.

§ 242 Abs. 1 StGB; co-possession and theft in a staged robbery involving an informed transport driver: At least co-possession of the owner is broken when cash boxes secured in a transport vehicle are taken by the participants, even if the driver is privy to the plan. A person participating in the taking cannot rely on the driver’s collaboration to exclude a taking from another’s possession; decisive is whether the factual power sphere of the owner remains protected (consid. as cited with reference to prior case law). Revision dismissed under § 349 Abs. 2 StPO when no legal error appears.
