The 2nd Criminal Senate of the Federal Court of Justice addressed a senate disagreement on the scope of § 306a(1) No. 1 StGB. It held that the provision applies to a single, unified building that is used partly for commercial purposes and partly for residential purposes. The Senate expressly aligned itself with the requesting 4th Criminal Senate and abandoned the contrary view it had expressed in an earlier 2007 decision.
§ 306a Abs. 1 Nr. 1 StGB; Anwendung auf ein einheitliches, teils gewerblich, teils zu Wohnzwecken genutztes Gebäude. Ein Gebäude verliert den Schutz der Norm nicht dadurch, dass es neben Wohnräumen auch gewerblich genutzte Teile aufweist, sofern es sich um einen einheitlichen baulichen Zusammenhang handelt. Der Senat gibt die in BGH, Beschl. v. 19.7.2007 – 2 StR 266/07 vertretene abweichende Auffassung ausdrücklich auf und schließt sich der späteren Linie an (vgl. Beschl. v. 17.11.2010 – 2 StR 399/10).
