The Federal Court of Justice granted the defense counsel's application for a flat fee under Section 42(1) RVG. For work in the appeal proceedings, including the response to the prosecution's appeal and participation in the oral appeal hearing, the court set the fee at EUR 3,400 because the case was deemed particularly difficult and this corresponded to twice the maximum statutory fee for retained counsel.
§ 42 Abs. 1 RVG; flat fee for retained defense counsel in criminal appeal proceedings: A flat fee may be granted where the scope or difficulty of the case makes the statutory remuneration unreasonable. In assessing the amount, the court may take account of the special difficulty of the proceedings and fix the fee with reference to the statutory maximum fee; a multiple of that maximum can be appropriate where the burden of work and complexity justify it (consid. 1-2).

Wahlverteidigergebühr: Höhe der Pauschgebühr im Revisionsverfahren
Auf Antrag des Wahlverteidigers I. wird für dessen Tätigkeit im Revisionsverfahren eine Pauschgebühr in Höhe von 3.400 € festgesetzt.
1 Der Angeklagte beauftragte den Antragsteller mit der Erwiderung auf die Revision der Staatsanwaltschaft gegen das freisprechende Urteil des Landgerichts Potsdam vom 15. September 2006 sowie der Teilnahme an der Revisionshauptverhandlung.
2 Auf Antrag des Wahlverteidigers war gemäß § 42 Abs. 1 RVG eine Pauschgebühr für seine Tätigkeit im Revisionsverfahren festzustellen, welche aufgrund der Schwierigkeit des Verfahrens in Höhe des doppelten Höchstbetrags der gesetzlichen Gebühren eines Wahlanwalts festzusetzen war.
