Tenor

Die Rechtsbeschwerde gegen den Beschluss der 3. Zivilkammer des Landgerichts Lüneburg vom 29. Januar 2010 wird auf Kosten des Schuldners als unzulässig verworfen.

Der Gegenstandswert für das Rechtsbeschwerdeverfahren wird auf 10.001 Euro festgesetzt.

Gründe

1 Die gemäß § 574 Abs. 1 Satz 1 Nr. 1 ZPO, §§ 6, 7, 34 Abs. 2 InsO statthafte Rechtsbeschwerde ist unzulässig, weil die Rechtssache keine grundsätzliche Bedeutung hat und weder die Fortbildung des Rechts noch die Sicherung einer einheitlichen Rechtsprechung eine Entscheidung des Rechtsbeschwerdegerichts erfordert (§ 574 Abs. 2 ZPO).

2 1. Die von der Rechtsbeschwerde geltend gemachte Grundsatzbedeutung liegt nicht vor. In Rechtsprechung und Schrifttum ist anerkannt, dass erzielbare Verwertungskostenbeiträge, etwa nach §§ 170 f InsO, bei der Feststellung des verwertbaren Vermögens im Sinne von § 26 InsO zu berücksichtigen sind (LG Berlin ZInsO 2000, 224; HK-InsO/Kirchhof, 5. Aufl. § 26 Rn. 6; Pape, in Kübler/Prütting/Bork, InsO § 26 Rn. 7; Graf-Schlicker/Voß, InsO, 2. Aufl. § 26 Rn. 13; MünchKomm-InsO/Haarmeyer, 2. Aufl. § 26 Rn. 21; HambKomm-InsO/Schröder, 2. Aufl. § 26 Rn. 14; Uhlenbruck, InsO 13. Aufl. § 26 Rn. 13). Gleiches gilt auch für Einnahmen aufgrund von Verwertungsabreden bei Veräußerung von Gegenständen (FK-InsO/Schmerbach, 6. Aufl. § 26 Rn. 17; MünchKomm-InsO/Haarmeyer aaO). Die Frage, ob eine freihändige Verwertung und der Abschluss einer entsprechenden Verwertungsabrede zu erwarten ist, ist im Rahmen einer einzelfallbezogenen Prognoseentscheidung anhand der jeweiligen Umstände des konkreten Falls zu beurteilen.

3 2. Die gerügte Verfahrensgrundrechtsverletzung liegt nicht vor. Auf den Inhalt des Schriftsatzes vom 18. Dezember 2009 kam es nicht an. Soweit er eine Ergänzung des bisherigen, vom Beschwerdegericht berücksichtigten Vorbringens des Schuldners enthielt, betraf dies die derzeitige Einschätzung der Gläubigerin zur Frage eines freihändigen Verkaufs und einer entsprechenden Verwertungsabrede. Für die Frage der Eröffnung war dagegen eine Prognoseentscheidung zu treffen, die das Beschwerdegericht anhand der Beurteilung im Sachverständigengutachten treffen konnte.

4 3. Von einer weiteren Begründung wird gemäß § 4 InsO, § 577 Abs. 6 Satz 3 ZPO abgesehen.
