The Federal Court of Justice rejected the defendants' appeals against the Frankfurt am Main Regional Court judgment. It found no legal error to their detriment. In particular, the court upheld the lower court's treatment of counts 1, 2, and 4 as one act in concurrence under § 52 StGB because the reciprocal performances under the unlawful agreements were partly rendered in a bundled manner. Each appellant was ordered to bear the costs of his own appeal.
§ 52 StGB; multiple benefit acceptances under several corrupt agreements: concurrence exists where the reciprocal performances are at least partly bundled and serve several unlawful agreements; separate legal assessment of each count is not required if the dealings are not clearly divided. On review of the judgment, the Federal Court of Justice will uphold the lower court's concurrence assessment absent a legal error, particularly where the facts support a unified act structure (consid. supplement).

Bestechlichkeit: Tateinheit bei mehreren Vorteilsannahmen
Die Revisionen der Angeklagten gegen das Urteil des Landgerichts Frankfurt am Main vom 30. Juni 2009 werden als unbegründet verworfen, da die Nachprüfung des Urteils auf Grund der Revisionsrechtfertigungen keinen Rechtsfehler zum Nachteil der Angeklagten ergeben hat.
Jeder Beschwerdeführer hat die Kosten seines Rechtsmittels zu tragen.
Ergänzend bemerkt der Senat:
Hinsichtlich der Anklagevorwürfe 1, 2 und 4 hat das Landgericht zu Recht Tateinheit bejaht, weil die Gegenleistungen auf alle drei Unrechtsvereinbarungen teilweise zusammengefasst erbracht worden sind (vgl. BGHR StGB § 332 Abs. 1 Konkurrenzen 5; BGHSt 47, 22, 29; BGH wistra 2004, 29, 30; wistra 2004, 99, 102).
