The Federal Court of Justice refused legal aid for an intended complaint against the non-admission of a legal appeal. It held that such a complaint is not provided for by the ZPO against an order, that § 544(1) sentence 1 ZPO applies only to appellate judgments, and that neither an extraordinary complaint nor the Labour Court Act could help the applicant in an Anwaltshaftung case.
§ 114 Satz 1 ZPO; § 544 Abs. 1 Satz 1 ZPO: Legal aid is to be refused if the intended legal remedy has no prospect of success. A non-admission complaint under § 544 ZPO is available only against judgments of the appellate court, not against decisions rendered by order. An extraordinary complaint is not admissible as a substitute remedy; its availability is neither generally recognized nor constitutionally required. Provisions of the Labour Court Act, including § 92a ArbGG, are neither directly nor analogously applicable in an attorney-liability action (consid. 1).

Prozesskostenhilfe für eine Beschwerde gegen die Nichtzulassung der Rechtsbeschwerde
Der Antrag auf Bewilligung von Prozesskostenhilfe für eine Beschwerde gegen die Nichtzulassung der Rechtsbeschwerde im Beschluss der 20. Zivilkammer des Landgerichts Hannover vom 26. April 2010 wird abgelehnt.
1 Die Prozesskostenhilfe ist zu versagen, weil die in Aussicht genommene Rechtsverfolgung keine Aussicht auf Erfolg hat (§ 114 Satz 1 ZPO). Die Zivilprozessordnung sieht ausnahmslos keine Beschwerde gegen die Nichtzulassung einer Rechtsbeschwerde vor. Die Nichtzulassungsbeschwerde ist gemäß § 544 Abs. 1 Satz 1 ZPO ausschließlich gegen Berufungsurteile eröffnet, nicht aber gegen Entscheidungen, die in Beschlussform ergehen (BGH, Beschl. v. 16. November 2007- IX ZA 26/06, WuM 2007, 41). Der Weg einer außerordentlichen Beschwerde ist nicht eröffnet (BGHZ 150, 133 ff) und verfassungsrechtlich auch nicht geboten (vgl. BVerfGE 107, 395 ff). Die Vorschriften des Arbeitsgerichtsgesetzes einschließlich dessen § 92a, auf den sich die Antragstellerin stützt, sind in einem Anwaltshaftungsprozess weder direkt noch analog anwendbar.
