Tenor

Die Revision des Angeklagten gegen das Urteil des Landgerichts Hannover vom 27. November 2009 wird als unbegründet verworfen, da die Nachprüfung des Urteils auf Grund der Revisionsrechtfertigung keinen Rechtsfehler zum Nachteil des Angeklagten ergeben hat (§ 349 Abs. 2 StPO).

Der Beschwerdeführer hat die Kosten des Rechtsmittels zu tragen.

Ergänzend bemerkt der Senat:

Das Landgericht hat sowohl bei der Strafrahmenwahl als auch bei der konkreten Strafzumessung zu Lasten des Angeklagten berücksichtigt, dass sich dieser mit den anderen Bandenmitgliedern nicht aus persönlichen Gründen, sondern "nur zur Erlangung des wirtschaftlichen Ziels des Verkaufs von Drogen" zusammengeschlossen habe. Diese Erwägung verstößt gegen § 46 Abs. 3 StGB; denn mit dem Straftatbestand des Bandenhandels mit Betäubungsmitteln in nicht geringer Menge ist eine solche Intention wegen der für das Handeltreiben vorausgesetzten Eigennützigkeit jedenfalls bei täterschaftlicher Begehungsweise notwendig verknüpft. Soweit sich das Landgericht in diesem Punkt auf das Urteil des Senats vom 18. Juni 2009 (NStZ-RR 2009, 320, 321) stützt, hat es die dortigen Ausführungen missverstanden. Denn in jener Entscheidung hat der Senat die strafmildernde Erwägung gebilligt, dass die Bande sich primär aus persönlicher Verbundenheit zusammengeschlossen habe und daher nicht dem Bild der üblichen Bandenkriminalität entspreche.

Auf dem aufgezeigten Rechtsfehler beruht das Urteil indes nicht. Der Senat kann im Hinblick auf die sonstigen Zumessungserwägungen des Landgerichts und die nur drei Monate über dem gesetzlichen Mindestmaß festgesetzte Freiheitsstrafe (die Annahme eines minder schweren Falls kam nach den Umständen, insbesondere auch wegen der gehandelten Betäubungsmittelmenge, ersichtlich nicht in Betracht) ausschließen, dass das Landgericht ohne die rechtsfehlerhafte Überlegung auf eine niedrigere Strafe erkannt hätte.
