Tenor

Die Entscheidung des Niedersächsischen Oberverwaltungsgerichts über die Nichtzulassung der Revision gegen sein Urteil vom 22. Juni 2009 wird aufgehoben.

Die Revision wird zugelassen.

Die Entscheidung über die Kosten des Beschwerdeverfahrens folgt der Kostenentscheidung in der Hauptsache.

Der Wert des Streitgegenstandes wird für das Beschwerdeverfahren und für das Revisionsverfahren vorläufig auf jeweils 1 012 500 € festgesetzt.

Gründe

1 Die Beschwerde ist begründet. Die Revision ist nach § 132 Abs. 2 Nr. 2 VwGO zuzulassen, weil das Urteil des Niedersächsischen Oberverwaltungsgerichts vom 22. Juni 2009 von den Urteilen des Senats vom 19. September 1986 - BVerwG 4 C 15.84 - (BVerwGE 75, 34), vom 3. April 1987 - BVerwG 4 C 41.84 - (BRS 47 Nr. 63 = Buchholz 406.11 § 34 BBauG Nr. 117) und vom 26. Mai 1978 - BVerwG 4 C 9.77 - (BVerwGE 55, 369) abweicht und auf dieser Abweichung beruht.

2 Die Streitwertfestsetzung für das Beschwerdeverfahren beruht auf § 47 Abs. 1 Satz 1 und Abs. 3, § 52 Abs. 1 GKG, die vorläufige Streitwertfestsetzung für das Revisionsverfahren auf § 47 Abs. 1 Satz 1, § 52 Abs. 1 und § 63 Abs. 1 Satz 1 GKG.
