On the defense counsel’s application, Düsseldorf Local Court allowed the affected person to discharge a €500 fine imposed by an administrative fine notice by performing 50 hours of unpaid work within two months, as specified by the Youth Welfare Office, Mitte District Office. The affected person may instead pay the fine in full within the same period and must contact the designated office without being prompted. Failure to comply with the instruction or pay on time may lead to juvenile detention for up to one week under § 98(2) OWiG. The State Treasury must bear the court costs and the affected person’s necessary expenses.
Sections 98 et seq. OWiG permit a court, on application, to authorize an affected person to perform unpaid work in place of payment of a fine. The order may specify the number of hours, the body responsible for determining the work, and a time limit for performance. Payment of the fine remains an alternative where the order so provides. Failure to comply with the direction or to pay within the prescribed period may trigger the consequence provided by § 98(2) OWiG, including juvenile detention for up to one week.

Auf den Antrag des Verteidigers vom 0 wird angeordnet, dass der Betroffene anstelle der mit Bußgeldbescheid vom 0, Az.: X, Bußgeldbehörde: Stadtverwaltung D Amt 32, festgesetzten Geldbuße in Höhe von 500,00 EUR gemäß §§ 98 ff OWiG 50 Stunden unentgeltliche Arbeit nach näherer Bestimmung durch folgende Stelle:
bis zum Ablauf von zwei Monaten leisten darf.
Es steht ihm frei, innerhalb derselben Frist die Geldbuße vollständig zu bezahlen.
Der Betroffene hat sich unaufgefordert mit dem - Jugendamt - Bezirksamt Mitte in Verbindung zu setzen.
Kommt er dieser Weisung nicht nach oder zahlt er die Geldbuße nicht rechtzeitig, kann gemäß § 98 Abs. 2 OWiG Jugendarrest bis zu einer Woche als Ungehorsamsfolge verhängt werden.
Die Kosten des gerichtlichen Verfahrens sowie die diesbezüglichen notwendigen Auslagen des Betroffenen trägt die Staatskasse.
