Tenor

hat das Amtsgericht Düsseldorf

im schriftlichen Verfahren nach § 128 Abs. 2 ZPO

durch die Richterin am Amtsgericht N3

für Recht erkannt:

Die Beklagte wird verurteilt, an den Kläger 483,13 € nebst Verzugszinsen in Höhe von 5 %-Punkten über dem Basiszinssatz p. a. seit dem 23.11.2012 zu zahlen.

Im Übrigen wird die Klage abgewiesen.

Die Kosten des Rechtsstreits trägt die Beklagte zu 14,36 % und der Kläger zu 85,64 %.

Das Urteil ist vorläufig vollstreckbar.

Die Parteien können die Vollstreckung der jeweils anderen Partei gegen Sicherheitsleistung in Höhe von 110 % des zu vollstreckenden Betrages abwenden, wenn nicht die andere Partei sofort in gleicher Höhe Sicherheit leistet.
