für R e c h t erkannt:

Die Beklagte wird verurteilt, an den Kläger 386,50 € nebst Zinsen in Höhe von fünf Prozentpunkten über dem Basiszinssatz seit dem 12.01.2010 zu zahlen.

Im übrigen wird die Klage abgewiesen.

Die Kosten des Rechtsstreits tragen der Kläger zu 19% und die Beklagte zu 81%.

Das Urteil ist vorläufig vollstreckbar.
