im vereinfachten Verfahren gemäß § 495a ZPO ohne mündliche Verhandlung am 14.10.2008 durch die Richterin am Amtsgericht X

für Recht erkannt:

Die Beklagte wird verurteilt, an die Kläger 45,35 € Zug-um-Zug gegen Rückgabe des vorgerichtlich überlassenen Verrechnungsschecks über 45,35 € der X GmbH Düsseldorf vom 15.04.2008, Scheck-Nr. XXXXXXX zu zahlen. Im Übrigen wird die Klage abgewiesen.

Die Kosten des Rechtsstreits tragen die Kläger.

Das Urteil ist vorläufig vollstreckbar.
