für R e c h t erkannt:

Die Beklagte wird verurteilt, an den Kläger 2,28 € nebst Zinsen in Höhe von 5%-Punkten über dem Basiszinssatz seit dem 25.09.2007 zu zahlen.

Im Übrigen wird die Klage abgewiesen.

Die Kosten des Rechtsstreits trägt die Beklagte.

Das Urteil ist vorläufig vollstreckbar.

Die Beklagte kann die Zwangsvollstreckung durch den Kläger gegen Sicherheit in Höhe von 110% des vollstreckbaren Betrages abwenden, wenn dieser nicht zuvor Sicherheit in gleicher Höhe leistet.

Der Streitwert wird auf bis 300,00 € festgesetzt.
