In this first-instance civil judgment, the Düsseldorf Local Court partially granted the plaintiff’s claim against the defendant. It ordered the defendant to pay €533.19, with interest at five percentage points above the base rate, in exchange for the plaintiff returning all of the defendant’s tax documents still in the plaintiff’s possession. The remainder of the claim was dismissed. The plaintiff was ordered to bear one third of the litigation costs and the defendant two thirds. The judgment was declared provisionally enforceable.

Die Beklagte wird verurteilt, an den Kläger 533,19 Euro nebst Zinsen in
Höhe von 5 Prozentpunkten über dem Basiszinssatz nach § 1 des Diskont-
satz-Überleitungs-Gesetz vom 09.06.1998 zu zahlen Zug-um-Zug gegen
Herausgabe aller noch in seinem Besitz befindlichen steuerlichen Unterlagen
der Beklagten. Im übrigen wird die Klage abgewiesen.
Die Kosten des Rechtsstreits trägt der Kläger zu 1/3 und die Beklagte zu 2/3.
Das Urteil ist vorläufig vollstreckbar.
The plaintiff’s claim for payment and interest, conditional on returning the defendant’s tax documents still in the plaintiff’s possession.
The defendant must pay €533.19 plus interest at five percentage points above the base rate, against return of the tax documents still held by the plaintiff.
Allocation of the costs of the proceedings.
The plaintiff bears one third of the costs and the defendant two thirds.
