Tenor

hat das Amtsgericht Düsseldorf

ohne mündliche Verhandlung im schriftlichen Verfahren

gemäß § 495 a ZPO

am 20. Januar 2005

durch den Richter am Amtsgericht X

für R e c h t erkannt:

Die Beklagte wird verurteilt, an den Kläger 70,20 € nebst Zinsen in Höhe von

5 % über dem Basiszinssatz nach § 1 DÜG seit dem 17.5.2004 zu zahlen.

Im Übrigen wird die Klage abgewiesen.

Der Kläger hat die Kosten des Rechtsstreits zu tragen, die durch die Anrufung des unzuständigen Amtsgerichts Bonn entstanden sind.

Die Kosten des Rechtsstreits im Übrigen werden gegeneinander aufgehoben.

Das Urteil ist vorläufig vollstreckbar.

Von der Darstellung des Tatbestandes wird gemäß § 313 a Abs. 1 Satz 1 ZPO abge-sehen.
