Following an oral hearing on 13 May 2003, the District Court of Düsseldorf ordered the defendant to pay Attorney X EUR 1,733.92 as an advance on costs for his role as sole arbitrator in proceedings between the parties (arbitration docket 449/02G10). The defendant was permitted to assert its rights in subsequent proceedings. The court also ordered the defendant to bear the costs of the litigation. The judgment was subject to a reservation and provisionally enforceable.

Die Beklagte wird verurteilt, an Herrn Rechtsanwalt X, als Einzelschiedsrichter des zwischen den Parteien betriebenen Schiedsgerichtsverfahren (Az. des Schiedsgerichts: 449/02G10) Kostenvorschuss in Höhe von 1.733,92 EUR zu zahlen.
Der Beklagten bleibt vorbehalten, ihre Rechte im Nachverfahren auszuführen.
Die Beklagte hat die Kosten des Rechtsstreits zu tragen.
Das Vorbehaltsurteil ist vorläufig vollstreckbar.
