für R e c h t erkannt:

Die Beklagte wird verurteilt, dan den Kläger 340,06 EUR nebst 5 % Zinsen über

dem Basiszinssatz seit dem 19.10.2001 zu zahlen. Im übrigen wird die Klage

abgewiesen.

Die Kosten des Rechtsstreits tragen der Kläger zu 17 %, die Beklagte zu 83 %.

Das Urteil ist vorläufig vollstreckbar.

Von der Darstellung eines Tatbestandes wird abgesehen gemäß §§ 313 a, 495 a a.F.
