für R e c h t erkannt:

Die Beklagte wird verurteilt, an den Kläger 563,90 DM und an Herrn X, X Weg, X, 581,40 DM, jeweils nebst Zinsen in Höhe von 5 Prozentpunkten über dem Basiszinssatz nach § 1 DÜG seit dem 26.07.2001 zu zahlen.

Im Übrigen wird die Klage abgewiesen.

Der Kläger hat 73,68 % und die Beklagte hat 26,32 % der Kosten des Rechtsstreits zu tragen.

Das Urteil ist vorläufig vollstreckbar.

Der Kläger kann die Vollstreckung durch Sicherheitsleistung in Höhe von 400,-- DM und die Beklagte kann die Vollstreckung durch Sicher-heitsleistung in Höhe von 1.500,-- DM abwenden, wenn nicht die je-weils vollstreckende Partei vor der Vollstreckung Sicherheit in jeweils gleicher Höhe leistet. Die Sicherheitsleistung kann durch Bürgschaft einer Bank oder öffentlich-rechtlichen Sparkasse innerhalb der Bun-desrepublik Deutschland erbracht werden.
