Der Beklagte wird verurteilt, an den Kläger 344,93 € nebst Zinsen in Höhe von 5 Prozentpunkten über dem Basiszinssatz seit dem 17.01.2013 zu zahlen.

Die Kosten des Rechtsstreits werden dem Kläger zu 40 % und der Beklagten zu 60 % auferlegt.
