Tenor

Der Beklagte wird verurteilt, an die Klägerin 185,52 € nebst Zinsen in Höhe von 5 Prozentpunkten über dem jeweiligen Basiszinssatz aus 44,35 € seit dem 26.10.2007 und aus 141,17 € seit dem 04.07.2008 sowie 8,00 € vorgerichtliche Mahnkosten zu zahlen.

Im Übrigen wird die Klage abgewiesen.

Die Kosten des Rechtsstreits tragen die Klägerin zu 55 % und der Beklagte zu 45 %.

Das Urteil ist vorläufig vollstreckbar.
