In a first-instance civil action, the Bochum District Court ordered the defendants jointly and severally to release the plaintiff from the expert T.’s fee claim for €878.70, with interest at 5% above the base rate from 6 October 2005. The court dismissed the remainder of the claim. It allocated 80% of the litigation costs to the plaintiff and 20% to the defendants. The judgment was declared provisionally enforceable, subject to security provisions.

Die Beklagten werden verurteilt, als Gesamtschuldner den Kläger von Honoraransprüchen des Sachverständigen T., G.-straße, ##### K., zur Gutachten-Nr.: ###### vom 06.01.2005 in Höhe von 878,70 € nebst 5 % Zinsen über dem Basiszinssatz seit dem 06.10.2005 freizustellen.
Im übrigen wird die Klage abgewiesen.
II.
Die Kosten des Rechtsstreits tragen der Kläger zu 80, die Beklagten zu 20 %.
III.
Das Urteil vorläufig vollstreckbar.Die Parteien können die Vollstreckung durch Sicherheitsleistung eines Betrages in Höhe von jeweils 110 % des jeweils zu vollstreckenden Betrages abwenden, wenn nicht die jeweils andere Partei vor der Vollstreckung Sicherheit in jeweils gleicher Höhe leistet.
