Tenor

Der in der außerordentlichen Wohnungseigentümerversammlung vom 28.01.2010 unter Top 4 gefasste Beschluss "fristlose Kündigung des Verwaltervertrages" wird für ungültig erklärt.

Es wird festgestellt, dass der Verwaltervertrag nicht durch die Kündigung vom 28.01.2010 beendet worden ist.

Die Kosten des Rechtsstreits werden den Beklagten auferlegt.

Das Urteil ist vorläufig vollstreckbar. Die Beklagten können die Vollstreckung durch Zahlung einer Sicherheitsleistung in Höhe von 110 % des aufgrund dieses Urteils vollstreckbaren Betrages abwenden, es sei denn der Kläger leistet zuvor Sicherheit in Höhe von 110 % des jeweils zu vollstreckenden Betrages.
