Tenor

Die Beklagte wird verurteilt, an das Sachverständigenbüro B F - Kontonummer #######, BLZ ###### bei der T L 102,09 Euro nebst Zinsen in Höhe von 5 Prozentpunkten über dem Basiszinssatz seit dem 25.05.2007 sowie an den Kläger außergerichtliche Rechtsanwaltsgebühren in Höhe von 51,64 Euro zu zahlen.

Im übrigen wird die Klage abgewiesen.

Die Kosten des Rechtsstreits tragen der Kläger zu 68 % und die Beklagte zu 32 %.

Das Urteil ist vorläufig vollstreckbar.
