The Bonn Local Court partly upheld the applicants’ challenge to resolutions adopted at the condominium owners’ meeting on 18 June 2002. It declared the TOP 2 resolution on the 2001 annual accounts invalid with respect to the total-account item “written-off receivables T” and the individual accounts in their entirety. It also invalidated the TOP 3 special-assessment resolution. The applicants’ declaratory application was dismissed as inadmissible. The applicants were charged 19% of court costs and the respondents 81%; no out-of-court costs were reimbursed.
