Tenor

Die Anfechtung der Jahresabrechnung 1997 (TOP 2 des Beschlusses der Wohnungseigentümer vom 2.7.1998) wird als unzulässig zurückgewiesen.

Auf die Anfechtung der Jahresabrechnung wird festgestellt, daß die Antragstellerin nicht verpflichtet ist, ganz oder teilweise den Saldo aus der Jahresabrechnung 1997 vorweg gemäß § 155 Abs. 1 ZVG zu befriedigen.

Die Anfechtung zu TOP 3 (Wirtschaftsplan 1999) wird als unbegründet zurückgewiesen.

Die Verfahrenskosten werden gegeneinander aufgehoben.

Eine Erstattung der außergerichtlichen Kosten der Beteiligten findet nicht statt.
