Tenor

1. Der Beklagte wird verurteilt, an den Kläger 201,70 € zu zahlen. Im Übrigen wird die Klage abgewiesen.

2. Die durch die Beweisaufnahme entstandenen Kosten trägt der Kläger. Im Übrigen trägt der Kläger 88 %, der Beklagte 12 % der Kosten des Rechtsstreits.

3. Das Urteil ist vorläufig vollstreckbar. Die Vollstreckung kann durch Sicherheitsleistung in Höhe von 110 % des auf Grund des Urteils vollstreckbaren Betrages abgewendet werden, wenn nicht die andere Partei zuvor Sicherheit in Höhe von 110 % des jeweils zu vollstreckenden Betrages leistet.
