In this first-instance civil judgment, the Aachen District Court partially granted the plaintiff’s claim. Die Beklagte wird verurteilt, an den Kläger 281,58 € nebst Zinsen in Höhe von 5 Prozentpunkten über dem jeweiligen Basiszinssatz seit dem 08.02.2013 zu zahlen.
Die Beklagte wird desweiteren verurteilt, Zinsen aus einem Betrag in Höhe von 603,93 € in Höhe von 5 Prozentpunkten über dem jeweiligen Basiszinssatz für den Zeitraum vom 08.02.2013 bis zum 06.01.2014 zu zahlen.
Im übrigen wird die Klage abgewiesen.
Die Kosten des Rechtsstreits werden dem Kläger zu 40 % und der Beklagten zu 60 % auferlegt.
Das Urteil ist vorläufig vollstreckbar.
Der jeweilige Vollstreckungsschuldner darf die Vollstreckung durch Sicherheitsleistung oder Hinterlegung in Höhe von 110 % des vollstreckbaren Betrages abwenden, wenn nicht der jeweilige Vollstreckungsgläubiger vor der Vollstreckung Sicherheit in Höhe von 110 % des jeweils zu vollstreckenden Betrages leistet.
