The Local Court of Aachen partly granted the plaintiff’s civil claim against the defendants. The defendants were ordered jointly and severally to pay €462.50 with interest at five percentage points from 10 May 2004, and to release the plaintiff from liability for €98.02 in expert costs owed to T under an invoice dated 15 April 2004. The remainder of the claim was dismissed. The court allocated the costs of the proceedings equally between the plaintiff and the defendants, with the defendants jointly and severally liable for their half. The judgment was declared provisionally enforceable.

Die Beklagten werden als Gesamtschuldner verurteilt, an die Klägerin 462,50 Euro nebst 5 Prozentpunkte Zinsen seit dem 10.05.2004 zu zahlen und die Klägerin hinsichtlich der Sachverständigenkosten in Höhe eines Betrages von 98,02 Euro gegenüber dem Anspruch des Sachverständigen T, O-K-Straße 3b in ####1 K (Rechnung vom 15.04.2004) freizustellen. Im Übrigen wird die Klage abgewiesen.
Von den Kosten des Rechtsstreits hat die Klägerin 50% und die Beklagten als Gesamtschuldner 50% zu tragen.
Das Urteil ist vorläufig vollstreckbar.
