The District Court Passau denied lawyer W.’s application for appointment as duty counsel, which he had made in his own name for the accused. The court reasoned that § 141(1) StPO is intended to protect an accused’s ability to defend himself while detained, not to secure counsel’s financial interests. It also noted that the proceedings would shortly be discontinued and no further investigative acts had occurred. The court discontinued the proceedings under § 154(2) StPO because any expected additional sanction would not be significant beside the final unified youth sentence of two years and six months in another case. The Treasury was ordered to bear the proceedings’ costs, while the accused bears his own necessary expenses.

§ 141 Abs. 1 und Abs. 2 Satz 3 StPO; appointment of mandatory defence counsel on an application made by counsel in his own name. Section 141(1) StPO is directed at an application by an unrepresented accused and aims to counter restrictions on defence opportunities arising from detention; it does not extend to an application made by counsel in his own name to safeguard financial interests. Where proceedings are to be discontinued shortly and no further investigative acts are required, denial of appointment under § 141(2), sentence 3, StPO does not impair the accused’s right to defend himself. Under § 154(2) StPO, proceedings may be discontinued where the expected sanction is not of significant weight in light of a final sentence imposed in another proceeding.

AG Passau — 2021-01-08 — 22 Ds 13 Js 16532/20 — Beschluss

Entscheidungsdatum: 2021-01-08

Aktenzeichen: 22 Ds 13 Js 16532/20

Dokumenttyp: Beschluss

Tenor

The application was denied because it was made by counsel in his own name, rather than by the accused, and the proceedings were to be discontinued without further investigative steps.

Section 141(1) StPO addresses an application by an unrepresented accused to remedy restricted defence opportunities caused by detention, not to protect counsel’s financial interests. Section 141(2), sentence 3, StPO permitted denial in the circumstances.

The proceedings were discontinued because the expected sanction in this case would not carry significant weight alongside the final unified youth sentence imposed in the other proceeding.

The accused had received a final unified youth sentence of two years and six months in case 5 Ls 13 Js 3326/20; any additional sanction expected here was not substantial in comparison.

The Treasury bears the costs of the proceedings; the accused bears his own necessary expenses.

The cost ruling was based on §§ 464 and 467(1) and (4) StPO.
